    A Consent Decree is the maximum enforcement action the FDA can take. It’s a serious step that can be devastating to your business now and in the future.

    In order to get a Consent Decree, the FDA works with the Department of Justice (DOJ) to file a complaint against your business in Federal District Court. It’s important that your business responds to this kind of filing. Otherwise, a default judgement is entered against you. Most of the time, businesses do not fight the allegations, but settle the issue through a DOJ injunction.

    Consent decree bedeutet letztlich, dass die US FDA ernst macht und auf gerichtlichem Wege den Stopp aller laufenden Aktivitäten verfügt bis die von ihr beanstandeten Mängel behoben wurden.

    Es ist daher in seiner Wirkung als eine Art "Unterlassungsverfügung" bzgl. Herstellung, Prüfung, Vertrieb etc. von Waren zu sehen die der Kontrolle der Food & Drug Administration unterliegen.

    I know that there are people here who routinely complain about the uselessness of resurrecting an old thread, but Mandelbrot caught that #1 is off base. There's a difference between a "consent decree" and a "decree by consent"!
