"homicide" is US Engish, by the way. In the UK they say murder or manslaughter (intentional, unintentional)

i am well aware of the fact that manslaughter is BE for Totschlag and that homicide is AE. This, however, was not the question I have been asking. As I have to translate a text dealing with some of this nice things some people do, I need the correct translation for unterlassene Hilfeleistung mit Todesfolge.

And by the way, it is a crime in most other countries, too.

Beim zweiten würde ich eher "homicide due to failing..." schreiben.


Kontext für "if death results"? Schwierig, ohne zu wissen, was du genau sagen möchtest. Ich würde es dann nutzen, wenn der Tod des Verletzen eingetreten ist. Meinst du vielleicht i.S.v.: Wenn der Tod durch Ihre Rettungsmaßnahmen eintritt, können keine Ersatzansprüche gestellt werden?

Als Beispiel.

Auch die Übersetzung des StGB durch das Bundesjustizministerium verwendet für die "unterlassene Hilfeleistung" (§ 323c StGB) "failure to render assistance".

Bei den erfolgsqualifizierten Delikten "... mit Todesfolge" (§§ 176b, 178, 227, 251, 306c) wird das auf Englisch mit "resulting in death" wiedergegeben.

Allerdings frage ich mich, was für einen Text Du da übersetzt. Einen Tatbestand namens "unterlassene Hilfeleistung mit Todesfolge" gibt es nämlich im deutschen Recht nicht. (In der Schweiz heißt es "Unterlassung der Nothilfe", Art. 128 schwStGB, in Österreich "Unterlassung der Hilfeleistung", § 95 öStGB.)

Totschlag durch Unterlassen würde ich mit "homicide by omission" übersetzen. Das ist allerdings nicht dasselbe wie eine unterlassene Hilfeleistung, bei der das Opfer gestorben ist.
