Ich kann nicht erkennen, warum der Begriff "Fiktionsbescheinigung" "schwachsinnig" (#7) oder eine "juristisch angehauchte Sprachverrenkung" (#11) sein soll. Nach der oben belegten Regelung gilt der Aufenthalt eines Ausländers unter den dort genannten Umständen bis zur Entscheidung der Ausländerbehörde als erlaubt ("his or her residence is deemed to be permitted") - obwohl er es "eigentlich" nicht ist! Eine Bescheinigung über diese "Fiktion" (gesetzliche Anordnung, tatsächliche oder rechtliche Umstände als gegeben zu behandeln, obwohl sie in Wirklichkeit nicht vorliegen) "Fiktionsbescheinigung" zu nennen, halte ich keineswegs für gesteigert rechtssprachlich ("legalese") oder gar abwegig. Daß der Gesetzgeber dabei nicht daran gedacht haben mag, wie dieser Ausruck ins Englische oder eine andere Fremdsprache zu übersetzen ist, ändert daran nichts.

I can't speak to how the word strikes DMS, but once I'd grasped what it was, I could see why Fiktionsbescheinigung makes a kind of sense. I think of it as a document attesting to a legal fiction (an assumption or acceptance of something as fact for legal purposes, even though it may not be true - to paraphrase the definition at the site linked above, though it says that a legal fiction is one assumed/accepted by a court ). A translation of "Fiktion-" with an adjective is a bit problematic in English, because that makes the natural reading one in which the certificate itself fictional. After some head scratching and perhaps a cup of coffee, one might think "certificate relating to a fiction", so I suppose there is a case to be made for the IATE translation.

I would translate it as the ministry does, provisional residence document, so the readers can find it in the law and the BAMF's English website, and provide a gloss (if the context rendered that appropriate) modeled on the language in the statute (which quite similar but more specific to the proposal in #15): a certificate confirming that residence is deemed to be permitted until the time of the decision by the foreigners authority.
