    Erfindungsmeldung

    Kontext/ Beispiele
... heißt es in der „Erfindungsmeldung“ 1998 von Mitarbeiter XYZ
    Kommentar
I know there are patent experts out there:
It seems to be a set expression, as in this example:
    "Vom Entwicklungsprojekt bis zur Aufgabe eines Schutzrechts (§§ 5, 6, 13, 14, 16 ArbErfG): a)Erfindungsmeldung b)Patentanmeldung c) Auslandsanmeldung d)Schutzrechtsaufgabe"

    Thanks!

Ghol: I have never come across the term Erfindungsmeldung although I've been working at a U.S. IP firm for a number of years. It probably means that you are required to establish a point in time where you came up with the invention. The whole process is called "reduction to practice". Inventors often send themselves a registered letter outlining the exact details of their invention. If somebody else then comes along claiming the same invention, you can prove that you were there first.
Complicating this is the different standard in the U.S. and Europe, namely first to invent versus first to file.

Vorschlagreport of an employee's invention to his employer
    Kommentar
Your example refers to the Arbeitnehmererfindungsgesetz (ususally abbreviated as ArbNErfG)(http://bundesrecht.juris.de/bundesrecht/arbnerfg/), which might be translated as Inventions by Employees Act. In this context, "Erfindungsmeldung" is indeed a set expression.

If an employee makes an invention (arising from his work for that company) that can be protected by an industrial property right ("gewerbliches Schutzrecht", within the scope of the ArbNErfG this refers only to patents or registered designs), he is obliged to report the invention to his employer according to § 5 ArbNerfG (that's what "Erfindungsmeldung" means). In turn, the employer is obliged to have the invention patented in Germany ("Schutzrechtanmeldung im Inland", § 13) or abdicate his right to do so. The employer can also choose if he wants to have it patented in foreign countries ("Schutzrechtansmeldung im Ausland" = "Auslandsanmeldung", § 14) or leave that to the employee. If the employer is not interested in an industrial property right (anymore), he may abdicate his right ("Aufgabe des Schutzrechts" = "Schutzrechtsaufgabe", § 16), then it is up to the employee do decide on what to do with his invention.

Working at an IP department we do use special forms for the employees to inform us about their inventions. Our translator did translate the word "Erfindungsmeldung" with "Invention Disclosure" and we do offer special Invention Disclosure Forms.

I second matyo. That's what our patent attorneys say.

That sounds good. Are there any objections? Otherwise I'll propose it as a New Entry.

I don't know if this is the actual term used in the UK and/or the USA (entailing the consequences under patent law I outlined), but to me it sounds all right.

I second this translation from personal experience.
The invention disclosure reports the invention to superiors or IP firms, this might later be turned into a patent application and so forth.
